1. Introduction
These Terms of Service ("Terms", "Terms of Service", or "Agreement") govern your access to and use of the Trymovo website, applications, software, products, features, and related services made available through https://trymovo.co and any associated applications, dashboards, or services (collectively, the "Service").
The Service is operated by TESA AGENCY ("Trymovo", "we", "us", or "our").
By accessing, registering for, purchasing, subscribing to, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy and Refund Policy.
If you do not agree to these Terms, you must not access or use the Service.
2. About Trymovo
Trymovo provides software and related digital services designed to help users access and use the functionality described on our website, product pages, pricing pages, checkout pages, and within the Service.
The specific features, functionality, usage limits, integrations, storage limits, plans, and other deliverables applicable to your purchase are those presented to you before you complete your order.
We may introduce new features, improve existing functionality, or discontinue features from time to time. Where a change materially reduces the functionality included in a paid plan, we will take reasonable steps to notify affected customers where required by applicable law.
3. Eligibility
You must be legally capable of entering into a binding agreement in the jurisdiction where you live or operate in order to use the Service.
If you use Trymovo on behalf of a company, organization, or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms. In that situation, "you" includes both you and the entity you represent.
You are responsible for ensuring that your use of the Service complies with all laws, regulations, professional obligations, and contractual requirements applicable to you.
4. Account Registration
Certain features may require you to create an account. You agree to provide accurate, current, and complete information when registering and to keep that information updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring through your account.
You must immediately notify us if you believe your account has been accessed without authorization, your credentials have been compromised, or there has been another security incident involving your account.
You may not share, sell, transfer, rent, sublicense, or otherwise provide access to your account to another person except where your applicable subscription expressly permits multiple authorized users.
We may require account verification or additional information where reasonably necessary to protect the Service, our users, our payment providers, or to comply with legal or regulatory obligations.
5. Your Responsibilities
You are responsible for your use of the Service and for all content, information, files, data, materials, or other information that you submit, upload, transmit, generate, or otherwise make available through the Service ("User Content").
You agree that you will:
- use the Service only for lawful purposes;
- provide accurate information;
- maintain reasonable security over your account;
- comply with these Terms and applicable laws;
- respect the rights of other users and third parties;
- maintain appropriate backups of important information;
- ensure that you have the necessary rights to any User Content you submit;
- pay all applicable fees when due; and
- use the Service only in accordance with its intended functionality.
6. Prohibited Activities
You may not use Trymovo to engage in unlawful, fraudulent, abusive, deceptive, harmful, or otherwise prohibited activities.
You must not:
- violate any applicable law or regulation;
- infringe intellectual property, privacy, publicity, or other rights;
- upload or transmit malicious code, malware, viruses, or harmful software;
- attempt to gain unauthorized access to accounts, systems, networks, or data;
- circumvent authentication, security, access controls, or usage limits;
- reverse engineer, decompile, disassemble, or attempt to discover source code except where expressly permitted by law;
- use automated systems to abuse, overload, scrape, or disrupt the Service;
- interfere with the operation or security of the Service;
- impersonate another person or organization;
- misrepresent your identity, affiliation, or authority;
- use the Service for fraud, scams, phishing, or deceptive schemes;
- use the Service to facilitate unauthorized access to systems or information;
- upload content that you do not have the right to use;
- attempt to bypass payment requirements;
- use the Service to violate third-party platform terms;
- resell or sublicense access unless expressly authorized by us;
- use the Service to build a competing service using unauthorized access or extraction of our proprietary systems or data;
- use the Service in a manner that could reasonably cause harm to Trymovo, our users, payment partners, infrastructure, or third parties.
7. Acceptable Use and Compliance
Trymovo may restrict, suspend, or terminate accounts or transactions where we reasonably believe that an account or activity presents a risk of fraud, abuse, unlawful activity, security threats, payment disputes, chargebacks, or violations of these Terms.
We may also take reasonable measures to comply with applicable laws, court orders, regulatory requirements, payment network rules, or requests from competent authorities.
Where appropriate and legally permitted, we will provide notice and an opportunity to remedy a violation before taking action. We may, however, act immediately where delay could increase security, fraud, financial, legal, or other risks.
8. Free Trials and Promotional Offers
From time to time, Trymovo may offer free trials, promotional periods, discounts, credits, or other incentives.
Unless otherwise stated at the time of the offer, promotional offers are available only under the conditions presented during registration or checkout and may be limited to one offer per person, account, or organization.
If a free trial automatically converts to a paid subscription, the applicable price and renewal terms will be presented before you begin the trial where required by law.
You may cancel before the end of the trial period to prevent the applicable paid subscription from beginning.
9. Paid Plans and Pricing
Certain features of Trymovo require payment. Current pricing, billing periods, included features, usage limits, and applicable taxes will be displayed on our website or during checkout before you purchase.
Unless expressly stated otherwise, prices do not include taxes that may be required by your jurisdiction.
We may change pricing for future purchases or renewals. Where required by applicable law, we will provide advance notice of material pricing changes.
A price change will not retroactively alter a completed transaction.
10. Subscriptions and Automatic Renewal
If you purchase a subscription, your subscription will renew automatically for the applicable renewal period unless you cancel before the renewal date.
By purchasing a subscription, you authorize the applicable payment provider to charge the payment method associated with your purchase for recurring subscription charges.
You may cancel your subscription using the cancellation method provided through your account, billing area, subscription management link, or by contacting Trymovo support.
Unless otherwise required by applicable law or expressly stated in our Refund Policy, cancellation prevents future renewal but does not automatically create a refund for a billing period that has already begun.
11. Payments
Payments may be processed by third-party payment providers, including Paddle, where applicable.
Where Paddle processes a transaction as the merchant of record, Paddle may act as the authorized reseller and seller for the relevant transaction and may handle payment processing, applicable taxes, receipts, refunds, and customer payment support.
The payment provider's terms may also apply to your transaction.
You authorize the applicable payment provider to charge the payment method you provide for the amount shown at checkout, including applicable taxes and recurring charges where applicable.
You must ensure that your payment information is accurate and that you have authorization to use the payment method.
We may decline, cancel, or delay a transaction where payment authorization cannot be obtained or where we reasonably suspect fraud, abuse, unauthorized activity, or another payment-related risk.
Trymovo does not request or store full payment-card numbers when payment processing is handled by an external payment provider.
12. Merchant of Record
Where Paddle is used as the merchant of record, the applicable transaction is processed by Paddle in accordance with Paddle's applicable buyer terms and policies.
The transaction receipt or checkout experience will identify the applicable seller or merchant-of-record information.
Customer questions concerning payment processing, transaction receipts, refunds, or subscription billing may be handled through the payment provider where applicable, while product and technical support remains available through Trymovo.
13. Refunds and Cancellations
Refund eligibility is governed by our Refund Policy.
Nothing in these Terms limits or excludes any mandatory consumer, statutory, or other legal rights that cannot lawfully be excluded.
14. Chargebacks and Payment Disputes
If you believe a payment was made in error, contact us before initiating a chargeback where reasonably possible.
We will make reasonable efforts to investigate legitimate billing disputes and resolve them through the appropriate support or payment process.
Fraudulent or abusive chargebacks, including claims concerning services that were knowingly received and used, may result in account suspension or termination to the extent permitted by law.
Nothing in this section prevents you from exercising a legitimate statutory right to dispute a transaction with your financial institution.
15. User Content
You retain ownership of User Content that you submit to Trymovo, subject to the rights necessary for us to operate the Service.
By submitting User Content, you grant Trymovo a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, display, and otherwise use that content solely as reasonably necessary to provide, maintain, secure, improve, and support the Service.
You represent that you have all necessary rights, permissions, and authority to provide User Content to us and to grant the rights described above.
We do not claim ownership of your User Content merely because you use the Service.
16. Intellectual Property
The Service, including its software, source code, design, interfaces, trademarks, logos, graphics, documentation, text, databases, functionality, and other materials provided by Trymovo, is owned by or licensed to Trymovo and is protected by applicable intellectual property laws.
Except for the limited rights expressly granted under these Terms, no ownership or other intellectual property rights are transferred to you.
You may not copy, modify, distribute, sell, lease, sublicense, publicly display, publicly perform, reverse engineer, or create derivative works from the Service except where expressly permitted by law or by written authorization from Trymovo.
17. Feedback
If you provide suggestions, ideas, feedback, feature requests, or other recommendations regarding Trymovo, you grant us permission to use that feedback without restriction or compensation, provided that we do not disclose your confidential information in doing so.
18. Third-Party Services
Trymovo may integrate with or rely on third-party services, APIs, infrastructure providers, analytics providers, payment processors, authentication providers, hosting providers, communication services, or other external services.
Your use of third-party services may be subject to their separate terms and privacy policies.
We are not responsible for independent third-party services that are outside our reasonable control, although we will make reasonable efforts to maintain integrations required for the Service.
19. Availability and Service Changes
We aim to keep Trymovo available and reliable, but we do not guarantee that the Service will be uninterrupted, error-free, or available at all times.
Temporary interruptions may occur because of maintenance, upgrades, infrastructure failures, third-party outages, security incidents, telecommunications problems, or circumstances outside our reasonable control.
We may modify, suspend, or discontinue portions of the Service where reasonably necessary for security, legal, technical, operational, or business reasons.
20. Security
We implement reasonable technical and organizational measures designed to protect the Service and information processed through it.
However, no internet transmission, storage system, or electronic service can be guaranteed to be completely secure.
You are responsible for maintaining appropriate security practices for your account, devices, credentials, and information.
21. Privacy
Our collection and use of personal information is described in our Privacy Policy.
By using the Service, you acknowledge that your information may be processed as described in that Privacy Policy.
22. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis.
Trymovo does not guarantee that the Service will meet every individual requirement, operate without interruption, remain available forever, or be completely free from errors or defects.
We do not make warranties that cannot lawfully be excluded under applicable consumer protection or other mandatory laws.
23. Limitation of Liability
To the maximum extent permitted by law, Trymovo and its owners, employees, officers, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, business opportunities, goodwill, data, or anticipated savings, arising from or related to your use of the Service.
To the maximum extent permitted by applicable law, Trymovo's total aggregate liability arising from or relating to the Service will not exceed the amount you paid to Trymovo for the Service during the twelve months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
24. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Trymovo, its affiliates, officers, employees, contractors, and service providers from claims, liabilities, damages, losses, costs, and expenses arising from:
- your unlawful or unauthorized use of the Service;
- your violation of these Terms;
- your User Content;
- your violation of another person's rights; or
- your violation of applicable law or regulation.
25. Suspension and Termination
You may stop using Trymovo at any time.
We may suspend or terminate access to an account or the Service where reasonably necessary because of a material breach of these Terms, fraud, unlawful activity, security risks, non-payment, abuse, regulatory requirements, or other legitimate operational reasons.
Where appropriate and legally permitted, we will provide notice and an opportunity to resolve a breach before termination.
Termination does not affect rights or obligations that accrued before termination.
26. Data Following Account Termination
Following account termination, we may retain certain information as necessary to comply with legal obligations, resolve disputes, enforce agreements, prevent fraud, maintain security, or satisfy legitimate business requirements.
Other information may be deleted or anonymized in accordance with our Privacy Policy and applicable law.
27. Changes to These Terms
We may update these Terms from time to time to reflect changes to the Service, legal requirements, security practices, or business operations.
The updated Terms will be published on this page with a revised "Last Updated" date.
Where required by law, we will provide additional notice or obtain consent before material changes become effective.
Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the updated Terms to the extent permitted by law.
28. Governing Law
These Terms are governed by the laws applicable to US, without regard to conflict-of-law principles, except where mandatory consumer protection laws require otherwise.
Nothing in these Terms prevents a consumer from relying on mandatory rights or protections available under the laws of the country or jurisdiction where they reside.
29. Dispute Resolution
If you have a complaint or dispute, please contact us first so that we can attempt to resolve the matter informally.
You agree to give us a reasonable opportunity to investigate and resolve the issue before commencing formal proceedings, except where applicable law permits or requires otherwise.
30. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in effect.
31. Entire Agreement
These Terms, together with the Privacy Policy, Refund Policy, and any additional terms expressly incorporated by reference, constitute the agreement between you and Trymovo concerning your use of the Service.
